Why is my 3DS Top Screen Brightness stuck on 5th s even on low setting

Whenever i play at night or in a dark area the top screen is so blindingly bright it's somehow brighter than my bottom screen, the top screen is somehow always stuck on highest setting even when i change the brightness setting, due to this my console always drains fast like 30 - 1 hour of gameplay it's dead
